Workers Compensation and Washington Stop-Gap Coverage
Workers compensation pays medical costs and wage replacement when an employee is hurt on the job. In most of the states we serve, that coverage is purchased from a private carrier. Washington is different, and we treat it that way on every proposal.
Washington is a monopolistic workers-compensation state. Employers with Washington-situs payroll generally buy industrial insurance through the Department of Labor and Industries (L&I), not through a private workers-comp policy. Business Insurance Brokers does not replace L&I for Washington employees, and we will never imply that we can.
What we do for Washington-based companies is the rest of the program. If you have employees in Oregon, Idaho, Nevada, Arkansas, South Dakota, Pennsylvania, Texas, Indiana, or California, we place private workers compensation in those competitive states. If Washington employees travel or you have temporary out-of-state jobs, we design other-states coverage so a claim in Boise or Portland does not fall into a gap.
Stop-gap employer's liability is the piece Washington employers most often miss. L&I handles the statutory workers-comp benefits. It does not automatically provide the employer's-liability coverage that a private WC policy includes in competitive states — the coverage that responds to certain employee lawsuits that sit outside the exclusive-remedy statute. We place stop-gap for Washington employers, especially those with multi-state operations or contracts that require employer's liability limits.
In competitive states we quote guaranteed-cost programs and, when payroll and claims history support it, deductible or pay-as-you-go billing so cash flow tracks actual wages. Classification is half the battle: a contractor coded as clerical will not survive audit, and a warehouse coded as a store will overpay. We review class codes against how people actually spend their day.
Other-states coverage, incidental USL&H for rare dock or maritime-adjacent work, and voluntary compensation for exposures that do not fit a standard employee definition are available when the account needs them. We do not turn this page into a statute manual for ten states. Rules differ; the application is where we get specific.

Frequently asked questions
Can you write workers comp for my Washington employees?
Not as a private replacement for L&I. Washington employers buy industrial insurance from the state fund. We place stop-gap employer's liability and we write private WC for employees who work in competitive states.
What is stop-gap coverage?
Employer's liability for monopolistic-state payroll. It sits beside L&I and responds to certain employee claims that are not paid as statutory industrial-insurance benefits. Multi-state contractors and companies with out-of-state owners almost always need it.
We are an Oregon contractor with a short job in Washington. What do we do?
Oregon payroll stays on your private WC policy. Washington jobsite payroll generally has to be reported to L&I. We help you map which employees sit where so you are not paying twice — or leaving a state unpaid.
Do 1099 subcontractors need to be on my WC policy?
If they are true independent contractors with their own coverage, usually no — but states test that status, and a misclassified crew becomes your claim. We ask for their certificates and we are conservative when the facts look like employees.
Is pay-as-you-go billing available?
In competitive states, often yes. Premium tracks reported payroll instead of a large estimated deposit. Washington L&I has its own reporting calendar; we do not conflate the two systems.
